1. DEFINITIONS AND TERMS
1.1 Basic Definitions
"Platform" or "Service": MuzikDinle.ai website, mobile applications, and all related digital services.
"We," "Us," "Our," "Company": MuzikDinle.ai and its affiliates.
"You," "User," "Your": Any person or legal entity using the Platform.
"Content": Text, music, videos, images, audio recordings, comments, data, and all other materials.
"User Content": Content uploaded or created by users on the platform.
"Account": User's registered profile on the platform.

"DMCA": Digital Millennium Copyright Act.
"GDPR": General Data Protection Regulation.
"API": Application Programming Interface.
"DRM": Digital Rights Management systems.
"Business Day": Monday through Friday, excluding public holidays.
2. ACCEPTANCE OF AGREEMENT
2.1 Binding Nature
These Terms of Service constitute a legally binding agreement between you and MuzikDinle.ai. By using the Platform, you:

- Creating an account
- Uploading or downloading content

2.3 Refusal to Accept
If you do not accept these terms:
- Do NOT use the Platform
- Close any existing account
- Immediately cease all usage
- Delete any downloaded content
3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Age Requirements
Under 13: Platform use is STRICTLY PROHIBITED.
Ages 13-18: Parental or legal guardian consent is REQUIRED. Use without consent will result in immediate account closure.
18 and Over: Accepted as fully authorized user.
Age Verification: We reserve the right to verify age. False age declaration may result in legal action.
3.2 Legal Capacity
To open an account, you must:
- Have legal capacity to enter contracts
- Comply with laws in your jurisdiction
- Not be permanently banned from any platform
- Provide accurate identity information
3.3 Corporate Accounts
If opening an account on behalf of a company:
- You represent having authority to bind that legal entity
- You must have power to make binding contracts on behalf of the company
- Company information must be current and accurate
3.4 Required Information
Mandatory Information:
- Valid email address
- Strong password (minimum 8 characters, uppercase, lowercase, number)
- Unique username
- Date of birth
- Country/region
- Profile photo
- Biography
- Social media links
- Phone number (recommended for 2FA)
3.5 Information Accuracy
Information you provide must be:
- ✓ Accurate and current
- ✓ Complete
- ✓ Not misleading
- ✓ Not belonging to someone else
- ✗ Violates this agreement
- ✗ Is grounds for account termination
- ✗ May result in legal action
4. USER ACCOUNTS AND SECURITY
4.1 Account Responsibility
You are SOLELY RESPONSIBLE for your account security, including:
- Keeping your password confidential
- Not sharing login credentials
- Reporting suspicious activity
- Being responsible for all account activity
4.2 Password Security
Strong Password Requirements:
- Minimum 8 characters
- At least 1 uppercase letter
- At least 1 lowercase letter
- At least 1 number
- Special characters recommended (!@#$%^&*)
- Never share your password
- Don't reuse passwords from other sites
- Change regularly (every 90 days recommended)
- Avoid predictable passwords (birthdates, 123456, etc.)
4.3 Two-Factor Authentication (2FA)
Strongly Recommended: Enable 2FA for account security.
2FA Methods:
- SMS verification
- Authenticator apps (Google Authenticator, Authy)
- Email verification
- Security keys (YubiKey, etc.)
4.4 Unauthorized Access
If you suspect unauthorized access:
1. IMMEDIATELY change your password
2. Contact support@muzikdinle.ai
3. Terminate all active sessions
4. Enable 2FA
Liability: You are responsible for damages from unauthorized use due to your negligence.
4.5 Account Sharing
PROHIBITED:
- Sharing your account with others
- Multiple people using same account
- Commercial account sharing
- Selling/renting passwords
5. INTELLECTUAL PROPERTY RIGHTS
5.1 Platform Content Ownership
Owned by MuzikDinle.ai:
All rights to the following belong to MuzikDinle.ai or its licensors:
- Platform design and interface
- Logos, brands, trade names
- Software code and algorithms
- Database and data structures
- Visual design elements
- Sound effects and notification sounds
- APIs and integrations
- Documentation and help content
- ©️ Copyright
- ®️ Trademark
- 🔒 Trade Secrets
- 💡 Patents (if applicable)
5.2 Usage License
You are granted a LIMITED, NON-TRANSFERABLE, NON-EXCLUSIVE license:
Permitted Uses:
- ✓ Personal platform access
- ✓ Listening to/watching content
- ✓ Legal sharing features
- ✓ Creating playlists
- ✗ Downloading and distributing content
- ✗ Reverse engineering source code
- ✗ Commercial use (without license)
- ✗ Reselling content
- ✗ Removing/bypassing DRM
5.3 Trademark Usage
MuzikDinle.ai and related logos are registered trademarks.
Written Permission Required For:
- Using logos
- Using brand name
- Creating derivative works
- Use in commercial materials
6. USER-GENERATED CONTENT
6.1 Content Ownership
You RETAIN COPYRIGHT to content you upload, but grant us broad usage rights.
6.2 Platform License
By uploading content, you grant us:

- 🔓 Non-exclusive: You can use elsewhere too
- 💰 Royalty-free: No separate payment
- ⏰ Perpetual: While content remains on platform
- 🔄 Irrevocable: Some rights continue even after deletion
- 📤 Sublicensable: We can license to third parties
- 🔁 Transferable: Passes to new owner if company sold
- Reproduce (copy)
- Distribute (share)
- Publicly perform (display)
- Publicly communicate (streaming)
- Create derivative works (edit, remix)
- Commercial use
- Translate
- Convert formats
6.3 Content Representations and Warranties
By uploading content, you REPRESENT AND WARRANT:
Ownership Representations:

- ✅ You have all necessary rights
- ✅ You have authority to grant licenses
- ✅ You're not infringing third-party rights
- ✅ Content is your original work OR
- ✅ You have necessary licenses
- ✅ No copyright infringement

- ✅ Content complies with laws
- ✅ No contractual violations
- ✅ No privacy violations
- ✅ No trade secret violations
6.4 Content Standards
Acceptable Content:
- ✓ Original music works
- ✓ Legal cover versions
- ✓ Licensed remixes
- ✓ Your own performances
- ✓ Purchased beats (within license terms)
- ✗ Pirated content
- ✗ Unauthorized copies
- ✗ YouTube rips/conversions
- ✗ Copies of others' work
- ✗ Unauthorized sampling
- ✗ Copyright-infringing content
6.5 Cover Songs and Remixes
For Cover Songs:
- Mechanical license from original composer required
- Changing only vocals is NOT sufficient
- "Tribute" versions still require license
- Soundalike/karaoke versions prohibited
- Written permission from original artist MANDATORY
- Sampling license required
- Derivative work permission essential
- Profit-sharing agreement may be needed
7. COPYRIGHT POLICY
7.1 DMCA Compliance
MuzikDinle.ai fully complies with the Digital Millennium Copyright Act (DMCA).
7.2 Submitting Copyright Notices
If you believe your copyright has been infringed:

1. Description of copyrighted work
2. Exact URL of infringing content
3. Contact information (name, address, phone, email)
4. Good faith belief statement
5. Statement of accuracy under penalty of perjury

Processing Time: Reviewed within 72 hours.
7.3 Counter-Notification
If your content was wrongfully removed:

Processing: Reviewed within 10-14 business days.
7.4 Repeat Infringers
3-Strike Policy:
- 1st Violation: Warning + content removal
- 2nd Violation: 30-day account suspension
- 3rd Violation: Permanent account termination
8. PROHIBITED USES AND ACTIVITIES
8.1 Illegal Activities
STRICTLY PROHIBITED:

- ✗ Stealing credentials
- ✗ Phishing attacks
8.2 Harmful Content
UPLOAD PROHIBITED:

- Violence-inciting content
- Discriminatory propaganda
- Explicit material
- Sexual audio recordings
- Obscene lyrics (without warning)
- Child exploitation (reported immediately to police)
- Extreme violence content
- Torture recordings
- Live injury sounds
- Terrorist propaganda
8.3 Spam and Manipulation
PROHIBITED ACTIVITIES:

8.4 Other Prohibited Content
The following types of content are strictly prohibited on the Platform:

- ✗ Sale or promotion of illegal substances or products
- ✗ Sale of regulated or prohibited items
- ✗ Unlawful betting or gaming advertisements
- ✗ Fraudulent financial schemes
- ✗ Counterfeit or fake product sales
- ✗ Content endangering minors safety
- ✗ Content harmful to living beings
- ✗ Content encouraging self-harm
- ✗ Promotion of unlawful services or activities
9. CONTENT MODERATION
9.1 Moderation Rights
MuzikDinle.ai reserves the right to, WITHOUT PRIOR NOTICE:
- Review any content
- Remove content
- Edit content
- Label content
- Apply age restrictions
9.2 User Reporting
How to Report:
1. Click "Report" button next to content
2. Select reason
3. Provide detailed explanation
4. Attach evidence (if any)
5. Submit
Review Time: 24-72 hours
10. SERVICE USAGE RULES
10.1 Fair Use Policy
The platform is provided free for personal, non-commercial use.
Usage Guidelines:
- Use responsibly and within reasonable limits
- Do not abuse platform resources
- Do not use automated systems (bots) without permission
- Commercial use requires written permission

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability
- Fitness for particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of content
14.2 No Guarantees
WE DO NOT GUARANTEE:
- Uninterrupted service
- Error-free operation
- Security of data transmission
- Freedom from viruses/harmful components
17. LIMITATION OF LIABILITY
15.1 Liability Exclusions
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUZIKDINLE.AI SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages from use or inability to use Service
- Damages from unauthorized account access
- Damages from user-generated content
15.2 Maximum Liability
Our total liability shall not exceed $100 USD.
18. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless MuzikDinle.ai, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your content uploaded to the Platform
19. DISPUTE RESOLUTION
17.1 Governing Law
These Terms shall be governed by Turkish law without regard to conflict of law principles.
17.2 Arbitration
Disputes shall be resolved through binding arbitration, except where prohibited by law.
17.3 Jurisdiction
For disputes not subject to arbitration, you agree to exclusive jurisdiction of courts in Istanbul, Turkey.
20. CHANGES AND NOTIFICATIONS
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
21. FORCE MAJEURE
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including:
- Natural disasters
- War, terrorism, civil unrest
- Government actions
- Internet outages
- Power failures
- Pandemics
- Strikes and lockouts
22. MISCELLANEOUS PROVISIONS
20.1 Entire Agreement
These Terms constitute the entire agreement between you and MuzikDinle.ai.
20.2 Severability
If any provision is found unenforceable, remaining provisions remain in effect.
20.3 Waiver
Failure to enforce any provision does not waive that provision.
20.4 Assignment
You may not assign these Terms without our written consent. We may assign without restriction.

21.1 Account Hacking
If Hacked:

21.2 Death of User
Deceased User's Account:
Heir Requests:
- Death certificate required
- Identity verification mandatory
1. Memorial Account: Read-only, content preserved
2. Download: Retrieve uploaded content (if copyright holder)
3. Closure: Complete deletion
21.3 Service Closure
If Platform Shuts Down:
Notice: Minimum 90 days advance notice
User Rights:
- 30 days to download content
- Data portability tools provided
